EBA Progress: Lobbying in the State Tax Administration. EBA Met Head of the State Tax Administration of Ukraine Mr. Serhiy Buriak to Lobby for VAT Refund and Legislative Amendments Expected by Business Community. On 1 July 2009 the EBA had an off-the-record meeting with Head of the State Tax Administration of Ukraine Mr. Serhiy Buriak, and his Deputies Mr. Serhiy Chekashkin and Mr. Serhiy Lekar. Also other STAU experts were present at the meeting. At this meeting we discussed strategy of collaboration with the STAU and certain concrete issues, like: taxation of currency exchange differences; taxation of certain banking transactions; taxation of life insurance activity, definition of “royalty”, tax “gaps” in terms of invalidation of agreements and of course the VAT refund problems faced by the EBA members.
Constitutional Court's Decision on 13% Purpose Surcharge to the Import Duties
The Constitutional Court of Ukraine has ruled as unconstitutional the right of the Cabinet of Ministers to limit, cancel and prolong application of 13% temporary purpose surcharge to the import duties as it is stated in the respective Decision of the Constitutions Court of Ukraine No. 15-šļ/2009 dated 23 June 2009. After adoption of the Law on Amending Certain Legislative Acts of Ukraine for Improving Balance of Payment in Terms of Global Financial Crisis No. 923-VI dated 4 February 2009 the President of Ukraine applied to the Constitutional Court to confirm legitimacy and constitutionality of amendments introduced by the Law No. 923-VI to the Laws on Customs Tariff and on Foreign Economic Activity empowering the Government to decrease or even cancel temporary purpose surcharge to the import duties or to prolong it’s application for 6 months more.
Law on Basics of Public Private Partnership Adopted in the Parliament On 25 June 2009 the Parliament adopted the Law on Basics of Public Private Partnership (respective Draft Law registered with No. 3447-ä dated 14 April 2009). The Law is aimed at stipulating legal, economical and organisational basis for implementation of public private partnership (hereinafter – PPP) in our country. The EBA has strongly supported the idea of adopting the special law in this sphere that would define clearly the PPP mechanisms and their legal framework.
