Transport Shipping and Trade web-course: “Eco-inspections in Ukrainian ports. Legal issues for shipowners, masters and P&I clubs”

  Environmental control in the Ukrainian seaports always causes a lot of controversy, despite the quite clear legal regulation of this issue, outlined in the Decrees of the Cabinet of Ministers of Ukraine. Thus, State Environmental Inspectorate of Ukraine shall take water samples on board of the vessel from the source determined with regards to detected nature of contamination (solely concerning the substances being the reason for water area contamination in accordance with Water Quality Inspection Certificate). Environmental procedures and the ways how to protect business from demurrage of vessel due to merchant ship delays, we reviewed during an English-language webinar on Transport, Shipping and International Trade on eco-inspections in Ukrainian sea ports and legal issues for shipowners, masters and P&I clubs.   Together with the speaker, Mikhailo Selivanov, a leading lawyer of Interlegal the following issues were highlighted: Changes in the national legislation of Ukraine since 2019; Measures aimed at water sampling and analysis; Procedure for water sampling and analysis thereof performed by the State Environmental Inspectorate of Ukraine. And also conducted the case study on such questions, when, for example, Environmental inspectors have taken and analyze all water samples without engagement of USPA. Remember, the State Environmental Inspectorate of Ukraine should collect water samples at the place of contamination or on board a vessel only after receiving information from the USPA about the detected fact of contamination of the sea port area.
