The business met with the State Forest Resources Agency and the Ministry of Environment

    On May 3, a working meeting was held between representatives of the European Business Association, the State Forest Resources Agency, and the Ministry of Environment to discuss the issue of subsoil users access to subsoil within land plots located under forest plantations.  The essential topic of the meeting was the discussion of the Procedure for cutting down trees and shrubs and using the obtained timber in case of a change in the designated purpose of forest land plots or the establishment of servitude for their use for purposes not related to forestry. In addition, the discussion touched on issues related to the conversion of forest land plots into non-forest lands, approved by the Cabinet of Ministers Resolution No. 105 of February 4, 2023.  According to business representatives, Procedure No. 105 does not provide conditions for cutting down trees and shrubs for non-forestry purposes on land plots where agreements on exploration and mining works have been concluded to improve communication with subsoil users. Despite this, Viktor Smal, Deputy Chairman of the State Forest Resources Agency, Ihor Budzinskyi, Head of the Forestry and Forest Restoration Department of the State Forest Resources Agency, and Iryna Tarasova, Head of the Forest Protection and Forest Conservation Department of the Department for Sustainable Natural Resources Management of the Ministry of Environmental Protection and Natural Resources, shared proposals with business representatives to amend the Ukrainian Forestry Code and Procedure No. 105, which will help solve the identified problem.  During the meeting, it was agreed that the State Forest Resources Agency would provide explanations on its information resources regarding the procedures and deadlines for concluding/agreeing on easement agreements and agreements on exploration and mining works to improve communication with subsoil users. The Agency also studies the number of contracts and agreements submitted for approval/signature, successfully concluded contracts/agreements, refusals to conclude/agree on contracts/agreements, and the main reasons for refusal. Based on the results, the State Forest Resources Agency will share statistical data and common causes for rejections with subsoil users to improve cooperation. Therefore, at the end of the meeting, it was recommended to the subsoil users to use the provisions of Order No. 105 regarding the cutting down of trees and shrubs when changing the purpose based on the servitude agreement before the implementation of the proposals outlined above. And additional explanatory work will be conducted for representatives of territorial structural units on the correct application of the provisions of Order No. 105. In addition, the meeting participants were informed about a digital version of the forest ticket with the possibility of selecting only the grounds specified by law. The business thanked the State Forest Resources Agency and the Ministry of Environmental Protection and Natural Resources for the dialogue and hopes for further cooperation!
