Gender discrimination in advertising, what will happen next?

Sometimes the content of advertising materials raises questions about the admissibility of its content and the way of presenting information in terms of morality. The bold creativity of marketers prompted legislators to intervene in the situation and the result of such intervention is the adoption on September 10, 2021 of the Law On Amendments to the Law of Ukraine On Advertising to Combat Discrimination on the Grounds of Sex, signed on September 20, 2021. the next day it was handed over for signature to the President of Ukraine. The purpose of the new normative act is to counteract discrimination on the grounds of sex in the field of advertising, protect the rights of consumers of advertising and strengthen the responsibility for violating its requirements. As stated in the explanatory note to the draft law, it proposes to amend the definition of: “discriminatory advertising” and “discriminatory advertising on the grounds of sex”; strengthening the responsibility for violating the law on advertising; strengthening the protection of the rights of advertising consumers. According to the legislators, the adoption of the Law will help combat gender discrimination in advertising and the formation of a gender-sensitive information space, a culture of tolerance, and intolerance of all forms of violence among the general population; strengthen the protection of the rights of consumers of advertising, as well as promote the establishment of the legal order in the field of advertising.
