EBA Odesa Business Breakfast with Arzinger

  On November 4, 2016 the EBA Odesa Business Breakfast with Arzinger was held on the topic “Conduction during the search - forewarned is forearmed. The moderator of the meeting was Andriy Seliutin, Lawyer and Partner of the law union Arzinger and speakers were Kateryna Gupalo, Partner, Head of Criminal Law Practice and Oleksandr Maksymenko, Arzinger Attorney. In their speeches, speakers noted that despite promises to reduce the pressure on business by government agencies, particularly law enforcement and prosecution service, the reality is the opposite. The focus of law enforcement agencies has long ago expanded from the shadow business to companies that operate within the legal field. Searches come true for those for whom criminal proceedings seemed very distant. During the meeting participants learned how to know that the search was illegal (practical aspects that are worth special attention); learned about the importance of the IT security and technical support system; features of sorting of property (documents, money, valuables – is there something irrelevant that shouldn’t be hid?); what to do if there are violations from the side of an investigator; golden rules of conduct during the search, how to say “no” to an investigator; fixing violations during the search; proper filling of a protocol; and that to return property - mission possible!
