  The EBA welcomes publication and adoption of the Order of the Ministry of Environmental Protection and Natural Resources №55 from 29 January 2021, which unblocked the licensing procedure for the import/export of fluorinated greenhouse gases and goods containing them. At the end of last year, the Government adopted the Resolution on the list of goods, exports, and imports of which are subject to licensing for 2021 №1329, which provided that fluorinated greenhouse gases are controlled substances. Therefore, legal entities must obtain a license from the Ministry of Economic Development, Trade and Agriculture (Ministry of Economy) for the import/export of these gases or goods they contain starting from 1 January 2021. According to Resolution №1329, the Ministry of Economy must issue such licenses after the submission of an application by an economic entity and obtaining approval for the issuance of such a license by the Ministry of Environment. At the same time, the Ministry of Environment was not able to issue such approvals due to the lack of statutory form and procedure for issuing approvals, which led to the suspension of all export-import operations with fluorinated greenhouse gases or goods containing, for example, air conditioners, heat pumps. The EBA met with government officials and sent a number of official letters to the relevant authorities requesting that the necessary legislative changes be adopted as soon as possible and that the form and procedure for issuing such approvals be agreed upon. The business community is grateful to all involved public authorities for the accelerated process of approval, adoption, and registration of the Order of the Ministry of Environment №55, which approved the form and procedure for issuing the necessary approvals. We hope that the necessary licenses will be issued to all interested companies as soon as possible.
