Business does not support the resumption of unscheduled inspections of subsoil users during the war

  According to information provided by member companies of the European Business Association, the Government plans to resume unscheduled state supervision (control) measures in the field of geological exploration and rational use of subsoil by introducing amendments to Cabinet of Ministers of Ukraine Resolution No. 303 “On the Suspension of State Supervision (Control) Measures under Martial Law”. Subsoil users, members of the EBA, emphasise that the proposed amendments to Resolution No. 303 create significant risks for bona fide market participants and may negatively affect the stability of their operations. Ethical businesses are always prepared for such inspections, but in wartime, these controls can pose a challenge to their operations. First, the resumption of inspections would create additional pressure and obstacles for businesses that are already operating under extremely challenging conditions, including constant shelling, destruction of infrastructure and the need for its restoration. Second, the resumption of inspections contradicts the position of the State Regulatory Service of Ukraine, which has repeatedly refused to approve regulatory acts aimed at restoring state geological control during martial law. Third, the State Service of Geology and Subsoil of Ukraine already has the ability to carry out relevant control measures within the framework of existing legislation, without the need to resume unscheduled inspections. Entrepreneurs are also particularly concerned that the Programme of Activities of the Cabinet of Ministers of Ukraine declares the principle of a long-term moratorium on business inspections. Accordingly, the resumption of state control measures would in practice violate the Government’s declared priorities. The European Business Association calls on the Government not to adopt the draft amendments to Cabinet of Ministers Resolution No. 303 insofar as they provide for the resumption of unscheduled state supervision (control) measures in the field of geological exploration and rational use of subsoil.
