Certain drugs may become unavailable in 2021, – EBA

  The European Business Association has once again appealed to the heads of Government, the Ministry of Health of Ukraine, and the National Health Service of Ukraine to resolve the legal collision, which could lead to the unavailability of a number of drugs provided by the state under the medical guarantee program 2021. At the end of December 2020, the Verkhovna Rada promptly drafted and adopted amendments to the Law On State Financial Guarantees of Medical Care, which partially regulated the possibility of purchasing drugs outside the National List as previously requested by the European Business Association. The EBA thanks the Chairman and deputies of the Health Committee of the Verkhovna Rada of Ukraine for considering the problem and assisting in its solution. However, this step does not fully solve the problem. Also, it is necessary to make amendments to the bylaws to ensure an unambiguous understanding of the purchase of medicines outside the National List among all entities that can act as customers of the medical guarantee program (MGP). In particular, there should be a direct rule stating that it is allowed to purchase drugs that will not be subject to centralized procurement in 2021, as well as not included in the National List, but necessary for patients within the MGP. Having this direct rule as the CMU Resolution will remove doubts of market participants, enable healthcare institutions to plan purchases in 2021 in advance, and patients to be sure that there will be no obstacles to receiving free medical services under MGP in 2021. The European Business Association has developed and submitted to the Cabinet of Ministers, the Ministry of Health of Ukraine, and the National Health Service of Ukraine relevant proposals for amendments to the CMU Resolution №333 of March 25, 2009, to bring it into line with Law 121124-IX. The business emphasizes that today a fairly large number of drugs required under MGP are absent in the nomenclature intended for procurement at the centralized level, and in the National List for 2021. These include, for example, drugs for emergency medical care for bleeding, drugs for the treatment of respiratory disorders in newborns, drugs for the treatment of patients with myocardial infarction, drugs for the treatment of patients with acute stroke, and so on. The European Business Association calls on the Cabinet of Ministers of Ukraine, the Ministry of Health of Ukraine, and the National Health Service of Ukraine to consider this important issue and ensure that the necessary changes are adopted as soon as possible.
