The procurement of certain drugs may be suspended from January 1, 2022

  On November 19, 2021, the European Business Association appealed to the Verkhovna Rada Committee on National Health, Medical Care and Health Insurance, and the Ministry of Health of Ukraine to resolve the situation with the inability to procure medicines under the State Guarantees of Public Health (SGP) in 2022. On January 1, 2022, the previously postponed provision of the Law of Ukraine “On State Financial Guarantees of Medical Care” will enter into force. Thus, the procurement of drugs outside the National List of Essential Medicines will be prohibited. However, the National List does not currently contain drugs that have already been included in the updated clinical standards (treatment protocols), nor does it contain a large number of drugs used to treat COVID-19. At the same time, the patients are much in need of such drugs. Ensuring the availability of drugs under the SGP was the reason behind the postponement of the entry into force of the relevant provision of the Law (part 10 of Article 10) during previous years. After all, otherwise it would be impossible to provide quality medical services under the SGP, or in some cases their provision at all. The postponement period is coming to an end and the circumstances that caused it, unfortunately, have not changed. Will purchases of necessary medicines continue in 2022? So far, unfortunately, the question remains to be the rhetorical one. Given the situation, the EBA Health Care Committee proposed a solution to this problem - until December 31, 2021, to initiate and ensure the extension of the entry into force of Part 10 of Article 10 of the Law of Ukraine On State Financial Guarantees of Public Health to develop and implement a new positive list of medicines to replace the current National List (so that all the drugs needed to treat patients are covered). Such a list is developed by the Ministry of Health of Ukraine and approved by the Cabinet of Ministers. Therefore, the postponement period depends on the speed of implementation of this new List. The European Business Association appeals to the Verkhovna Rada Committee on National Health, Medical Care and Health Insurance, the Ministry of Health of Ukraine, and the National Health Service of Ukraine to resolve this issue as soon as possible so that the population of Ukraine is provided with state-guaranteed medical care in 2022 under the Medical Guarantee Program.   Be the first to learn about the latest EBA news with our Telegram-channel – EBAUkraine.
