Everything is gone! What if the primary documents are destroyed by war?

Martial law was introduced in Ukraine, which continues to this day. Unfortunately, as a result of fierce fighting, part of the territory of Ukraine was under the occupation of the enemy, and together with the territory, a significant number of our fellow citizens and businesses were under occupation. Some enterprises were destroyed, lost not only their own property, but also primary documentation, which confirmed accounting information, reporting, grounds for making calculations, etc. However, understanding the urgency of the problem, the legislators went to a business meeting and provided in Law No. 2173-IX dated 01.04.2022 the possibility to apply to the supervisory body with a corresponding notification about the loss or lack of access to primary documents caused by hostilities or temporary occupation. Such notification will be considered a basis for saving the indicators displayed by the taxpayer without the presence of primary documents, the obligation to maintain and store which is provided for by the legislation of Ukraine. By the same law, it is determined that after the submission of the said notice to the supervisory authority, a moratorium is introduced on the conduct of documentary checks for the tax periods specified in the notice. Therefore, if your business has suffered losses in connection with the war, we advise you not to delay, but to determine whether there are grounds for applying the appropriate notification to the supervisory authority.
