EBA welcomes approval of mechanism to block illegal online alcohol sales

  The European Business Association welcomes the adoption of draft law No. 15111-d regarding de-shadowing measures, which, among other provisions, introduces a mechanism for restricting access to websites and mobile applications used for the illegal sale of alcohol. The document also regulates the procedure for license holders to submit information about online resources engaged in the legal sale of alcoholic beverages. For the business community, this decision is both important and long-awaited. For more than two years, the Association’s experts have consistently emphasised the need to adopt secondary legislation required to implement the provisions of Law No. 3817-IX concerning the regulation of online alcohol sales and measures to combat the shadow market. Businesses actively participated in sector-specific discussions, working meetings, and consultations with public authorities, including the Parliamentary Committee on Finance, Tax and Customs Policy. Alcohol importers believe that the new rules will help create equal competitive conditions for all market participants, reduce distribution channels for illegal alcohol, and support the development of fair e-commerce practices. In wartime conditions, de-shadowing the market also means additional tax revenues from excise duty, VAT, and other payments needed to finance defence, infrastructure recovery, and social support for citizens. In addition to the economic effect, the new mechanisms will help protect consumers. Illegal online platforms are often used to distribute counterfeit or falsified alcoholic products that may pose a threat to people’s health and lives. The Association believes that restricting access to websites and mobile applications used for the illegal sale of alcoholic beverages is a logical completion of an important stage in the de-shadowing of the market.
