VB PARTNERS successfully defended the interests of Scania Ukraine in a lawsuit with a dealer worth UAH 123 million

  We have already described about the course of this complex case. Lets recall the key facts: At the end of 2019, one of Scanias dealers filed a lawsuit against the company to recover UAH 123 million of alleged lost profit and service fees. In September 2020, a judge of the Commercial Court of Kyiv oblast satisfied the claim in full, despite the complete lack of evidence. A week later, the judge, who made the controversial decision, resigned. That prevented the High Council of Justice from opening proceedings at Scanias complaint. The appellate court, composed of various panels, considered Scanias complaint against this decision for 8 months. The case received wide publicity: its outcome was watched by the Verkhovna Rada, the Swedish Embassy, ​​representatives of the business community and the media. The lawyers of VB PARTNERS, challenging the decision of the court of first instance, noted the complete unfoundedness and far-fetchedness of the dealers claims. On June 24, the Northern Commercial Court of Appeal overturned the decision of the first instance and collected court fees in the amount of more than UAH 1 million from the dealer. The project was carried out by attorneys-at-law Oleksandr Lukianenko and Stanislav Yena. Scania is one of the first foreign investors in independent Ukraine. It is a part of the TRATON GROUP, which unites such brands as Scania, MAN and Volkswagen, Caminhões e Ônibus, and is also a leading global supplier of trucks, buses and engines for heavy transport.
