Gestors Attorneys Successfully Defended Skyeton in the Supreme Court in a Dispute over UAH 79.2 Million in Penalties

  Attorneys Association Gestors successfully represented Skyeton LLC before the Supreme Court of Ukraine in a dispute brought by the Deputy Prosecutor General on behalf of the State Service of Special Communications and Information Protection of Ukraine and its Procurement Department, seeking recovery of UAH 79.2 million in contractual penalties. The key issue in the case was whether the prosecutor had the statutory authority to bring the claim before the court on behalf of the State. Attorneys Association Gestors team argued that the prosecutor lacked proper legal grounds to represent the interests of the State Service of Special Communications and Information Protection of Ukraine, as the Service is a separate legal entity capable of independently protecting its rights. In considering the case, the Supreme Court relied on the Constitutional Court of Ukraine’s legal positions concerning the constitutional powers of the prosecution authorities, including those set out in its 2019, 2020 and 2025 decisions. The Supreme Court ultimately upheld Gestors’ legal position and left in force the appellate court’s decision returning the prosecutor’s claim without consideration. The decision reflects the Gestors team’s comprehensive work and deep expertise in commercial procedure, representation of the State’s interests and the application of the Supreme Court’s legal positions.
