Subsoil use, Industrial Ecology and Sustainable Development

  The European Business Association welcomes the Governments decision to allow holders of special permits for subsoil use issued before March 28, 2022, to make changes on the grounds specified in the current version of the Subsoil Code. According to the EBA member companies, these changes will affect more than 600 subsoil users who have permits for geological exploration, including pilot industrial development (hereinafter GE and PID) of mineral deposits. The relevant provision is reflected in the Resolution of the Cabinet of Ministers No. 1399, dated December 27, 2023. Earlier this year, the EBA experts drew attention to the incomplete regulation of the algorithm for amending the existing special permits (for GE and PID) issued to subsoil users before March 28, 2023. In addition, to ensure proper observance of the rights and interests of the holders of permits for GE from the PID, the EBA proposed in an appeal to the Head of the State Service of Geology and Mineral Resources of Ukraine and the Minister of Environmental Protection and Natural Resources of Ukraine to consider the possibility of enshrining such a procedure at the regulatory level. We are grateful to the Government for considering the business proposals that will improve the implementation of subsoil users rights.
