  Thanks to the efforts of the European Business Association (EBA), a problem with the national conformity mark on the cosmetic products at the market was resolved by amending the National Standard of Ukraine (ДСТУ) 2296-93 “Certification system of the Unified State System of Certification and Standardization in Ukraine (УкрСЕПРО). Conformity mark. The form, size, technical requirements and rules of application”. The problem for some producers and importers of cosmetics emerged after the Ministry of Economic Development and Trade of Ukraine Order #451 dd. 06.05.2015 (Order #451) which, among other things, excluded section 2 “Detergents” from the List of products subject to compulsory certification in Ukraine, on 5 June 2015. The result was that some categories of products such as, for example, shampoos, liquid soaps, hair styling products etc. were not subject to the Technical Regulations for detergents, therefore, cannot have the national conformity mark that is applied on the outer surface of the packaging or label. Decree of the Cabinet of Ministers of Ukraine “On standardization and certification” #46-93 dd. 10.05.1993 stipulates that companies, after obtaining the certificate of conformity, shall be entitled to label products with a special mark of conformity, form, size and technical requirements which are identified by the National Standard of Ukraine (ДСТУ) 2296-93 “Certification system of the Unified State System of Certification and Standardization in Ukraine (УкрСЕПРО). Conformity mark. The form, size, technical requirements and rules of application”, which sets different image of conformity marks depending on the type of certification (mandatory and voluntary). Considering that, at the time Order #451 entered into force, in circulation was a large number of cosmetic products, with a compulsory certification mark on its packaging and a valid certificate of conformity to avoid misunderstandings associated with misleading consumers through failures in labeling the compulsory certification mark. The Association appealed to the state authorities to resolve this situation. We thank the Ministry of Economic Development and Trade of Ukraine for understanding the problem and their quick response on changes by the State Enterprise “Ukrainian research and studying Institution on standardization, certification and quality problems”. Also, we express our sincere gratitude to the Association member companies that actively contributed to the settlement of this issue, in particular their expertise and vision for resolving the situation. The changes came into force on 7 December 2015. Under the changes, the mandatory certification mark is also used to refer to products, mandatory certification of which was cancelled for no more than two years ago, but which were certified voluntarily and initiated by the manufacturer (performer), seller (supplier) or consumer of products for compliance with all the requirements established by necessary certification.
