  Due to the long-lasting efforts of the European Business Association (hereinafter – the EBA), the Cabinet of Ministers of Ukraine (hereinafter – the CMU) has finally adopted the CMU Resolution “On Amendments to the Rules of Application of National Conformity Mark” No312, dated 6 August 2014 (hereinafter – the CMU Resolution No312). Background: The CMU Resolution “On Approval of Description and Rules of Application of National Conformity Mark” No1599, dated 29 November 2001, provided an obligation to label with the National conformity mark (hereinafter – the National mark) the products described in the technical regulations, and indicated the National mark’s application rules (hereinafter - Rules). At the same time, some of the wording of the Rules induced a lot of problems for business as a result of the inability to label certain products with the National mark, caused by the products’ design, their properties, economic reasons or other factors. The EBA conducted a variety of working meetings and roundtables and sent numerous appeals to the state authorities on this subject matter. Due to the position of the CMU, on 19 March the Ministry of Economic Development and Trade of Ukraine (hereinafter – the Ministry) issued the Draft CMU Resolution “On Amendments to the Rules of Application of National Conformity Mark” aimed at solving this issue, which was approved by CMU Resolution No312 and set out clause 5 of the Rules as follows:“The national conformity mark is labelled on the product or on a sticker, container, packaging, operating and shipping documentation when it is impossible or unjustified to label it directly on product, or if not foreseen by the technical regulations”. We would like to express our gratitude to the Ministry and the CMU in general for their effective and constructive cooperation in finding a solution to this very important issue. Moreover, we would like to thank all EBA members who supported and contributed to the EBA lobbying efforts that resulted in this success!
