Regulatory Affairs

27/ 07/ 2022
The government postponed the date of entry into force of the Technical Regulation on cosmetic products The European Business Association has always supported the need to harmonize the field of technical regulation in Ukraine following the Directives of the European Union, including the need to adopt the Technical Regulation on cosmetic products (TR on cosmetic products), which was supposed to enter into force on August 3, 2022. At the same time, to fully launch TR on cosmetic products, state authorities had to adopt the procedure for notifying (providing) information about cosmetic products, launch a portal for the registry of cosmetic products, adopt several methodological recommendations developed based on European guides on the application of similar regulations, etc. Unfortunately, the aforementioned documents were not accepted on time, and the corresponding portal did not have time to launch. Therefore, the member companies of the Association had serious reservations about the practical possibility of the entry into force of the TR requirements for cosmetic products already in August. That is why, to avoid a potentially difficult situation on the market of cosmetic products from August 3, the Association appealed to the Ministry of Health of Ukraine with a request to initiate a postponement of the entry into force of the TR on cosmetic products. Therefore, the Association thanks the Government for the adoption of Resolution 833 of July 26, which postponed for 2 years the entry into force of the TR on cosmetic products and introduced an additional 2-year transition period from the moment of entry into force, during which cosmetic products can be put into circulation both under old and according to new procedures. Such a transition period, according to the business, will allow testing the operation of TR for cosmetic products and allow all stakeholders to more easily adapt to new requirements.
