  The Verkhovna Rada adopted the draft law on administrative procedure On November 16, the Verkhovna Rada of Ukraine adopted the draft law No. 3475 on administrative procedures, which establishes the principles that administrative bodies should follow in their work with businesses and citizens, namely: the rule of law, equality before the law, impartiality of the state body, transparency, timeliness, and efficiency. The European Business Association has always supported the need for improving the procedures of state authorities and their officials and advocated for the adoption of the Bill No. 3475. The Bill No. 3475 defines the status of administrative bodies, the composition and status of participants in administrative proceedings, their rights, and obligations, etc. One of the innovations of the Bill No. 3475 is the regulation of the mechanism for the succession of administrative bodies, which is of utmost importance for both businesses and citizens who receive various administrative services. Among other important innovations for businesses, it is worth mentioning the regulation of the administrative appeal procedure for decisions or actions of various state bodies. Such a procedure exists in any advanced democratic state and allows for the quicker resolution of issues faced by businesses and citizens, while also significantly relieving the burden on the judicial branch of power. However, for the administrative appeal procedure to be truly effective, clear regulations of all procedural aspects are necessary. This ensures that civil servants act not arbitrarily but in accordance with well-established procedures. This, firstly, ensures equality of individuals before the law, as all similar cases are subject to the same procedure. Secondly, the existence of a legislatively established procedure serves as a starting point for exercising control, including judicial oversight, over the legality of the activities of government bodies. The European Business Association expresses gratitude to the Parliament for supporting the draft law and hopes for its prompt signing by the President of Ukraine!
