  Amendments to the Governmental Resolution “On Adoption of Technical Regulations on Energy Labelling of Consumer Electronics” Following the lobbying efforts of the Consumer Electronics Committee of the European Business Association (hereinafter – the Committee and the EBA respectively), the State Agency on Energy Efficiency and Energy Saving of Ukraine (hereinafter – the State Agency) has elaborated a draft Resolution of the Cabinet of Ministers of Ukraine (hereinafter – the CMU) “On Amendments to the CMU Resolution “On Adoption of Technical Regulations on Energy Labelling of Consumer Electronics” No702 dated 7 August 2013(hereinafter – the Draft Resolution) in line with the EBA position voiced a number of times and published it on its official web-site for public consideration. Background: The CMU Resolution “On Adoption of Technical Regulations on Energy Labelling of Consumer Electronics” No702 dated 7 August 2013 (hereinafter –CMU Resolution №702) was elaborated on the basis of a number of EU Directives (in particular, the Directive 2010/30/EU; the Commission Delegated Regulation No1060/2010; and the Commission Delegated Regulation No1061/2010) and created a regulatory framework by adopting the relevant technical regulations for applying labelling for energy products, household electric refrigerators and household washing machines. At the same time, CMU Resolution No702 required some amending in order to be fully harmonized with the relevant EU Directives. Thus, the EBA Committee has actively advocated the necessity to amend CMU Resolution No702 and provided a number of proposals, in particular related to the requirement to provide all technical documentation in Ukrainian, to the clear division of responsibilities between manufacturers and suppliers, to the scope of the respective technical regulations and some other essential amendments. As a result, the State Agency elaborated the Draft Resolution taking into account the abovementioned Committee proposals and published it on its official website for public consideration. Therefore, the EBA welcomes the Draft Resolution and believes that this is an important step towards the harmonization of Ukrainian technical regulations with EU legislation. We would like to express our gratitude to the State Agency for their effective and constructive cooperation and active support in this matter, and hope that the CMU will confirm and adopt the Draft Resolution shortly. Moreover, we would like to thank all EBA members who supported and contributed to EBA lobbying efforts that resulted in this progress and we will keep you updated on all further developments!
