Meeting on Tax Changes with the “Blagomay” Charitable Foundation

  Supporting the army, assisting hospitals, internally displaced persons, and vulnerable groups — since the first days of the full-scale war, Ukrainian businesses have been actively engaged in charitable activities. At the same time, the government has been gradually updating tax legislation to further encourage such efforts.  These legislative changes were the focus of an online meeting held on May 13, initiated by the European Business Association in partnership with the “Blagomay” Charitable Foundation. The event brought together company representatives from various regions of Ukraine, as well as experts from the Main Department of the State Tax Service in the Kharkiv region, who provided professional clarification on tax policy changes related to charitable activity.  Key aspects of the updated tax rules were presented by Serhiy Shcherbak, Member of the Supervisory Board and Legal Advisor of the “Blagomay” Foundation, and Managing Partner at Berchillz Ukraine Law Firm. He provided a detailed explanation of the new conditions for companies that donate to non-profit organizations. In particular, businesses are no longer required to adjust their financial results for the amount of such aid, provided certain conditions are met — for example, the total amount of donations must not exceed 8% of the previous year’s taxable profit, with at least 4% directed to organizations listed in the official Registry of Non-Profits.  Participants had the opportunity to delve deeper into several critical topics, including:  Changes in corporate income tax for charitable companies: what criteria must be met to qualify for tax benefits, and how to avoid common mistakes in expense reporting;  VAT relief in the context of humanitarian aid: when such deliveries are exempt from VAT and how to properly document them;  Cooperation with non-profit organizations: how to verify the recipients status and correctly formalize contracts and reporting to retain tax advantages;  Tax benefits for companies providing aid to individuals: what legal limitations and reporting requirements are in place;  Additional incentives — such as exemption from the military levy for donations made through registered charitable funds, customs exemptions for humanitarian goods, and non-taxable monetary aid to individuals affected by the war (up to 500 minimum wages annually, which amounts to UAH 3,550,000 in 2025).  Representatives of the “Blagomay” Foundation also shared practical cases and recommendations for effective cooperation with non-profits, as well as guidance on proper documentation and legal risk avoidance.  The European Business Association sincerely thanks all participants for their active engagement and commitment to fostering a culture of responsible business. In times of constant challenges, it is the cooperation between the state, charitable organizations, and businesses that ensures help reaches those who need it most.
