Advocacy achievements of the week

  The European Business Association community ends the week on a positive note! We have 8 achievements to share with you – they are in the field of taxation, IT, logistics, electronic payments, and agrochemicals: The Verkhovna Rada did not support the postponement of the use of cash registers  The Verkhovna Rada refused to consider draft law №6376 which was an attempt to postpone the mandatory use of cash registers. The European Business Association thanks MPs and personally the Chairman of the VRU Committee on Tax and Customs Policy Danylo Hetmantsev for supporting transparent businesses in this regard.  The tax component of Diia.City was approved  The Verkhovna Rada voted with 285 votes in favor of draft law №5376 on tax rates and terms in the Diia.City, a special regime for the IT industry. The IT community of the European Business Association welcomes the adoption of this document, which will be a new impetus for the further development of the IT industry in Ukraine. No more problems with data processing from cloud storage located outside Ukraine   Yesterday, the VRU passed draft law №6055 which corrects a critical error regarding the transfer and processing of personal data using cloud storage with servers located outside Ukraine. Thus, there was a detrimental rule that forbade companies to process and store personal customer data in such storage. Draft law №6055 removes this detrimental rule which imposes such unconditional restrictions. We are currently waiting for the Presidents signature for this amendment to come into force on January 1, 2022.  The Government has agreed to increase liability for railway thefts and disruptions to transport   The European Business Association welcomes the decision of the Government to approve the draft Law On Amendments to the Criminal Code of Ukraine to strengthen the responsibility for interfering in the activities of railway transport. The document significantly raises fines for obstructing the normal operation of railway transport. It also provides for the regulation of scrap collection points. It will be recalled that the EBA Logistics Committee experts actively worked on drafting the text of the document together with the Ministry of Infrastructure of Ukraine followed by two-year communication with the authorities on the need to adopt this draft law.  The Law of Ukraine “On Insurance” was adopted   This week, the Verkhovna Rada of Ukraine adopted the Law of Ukraine “On Insurance” (draft № 5315), which provides for the introduction of a new regulatory model aimed at creating a solvent, stable, competitive insurance market in Ukraine. All key EBA proposals to the draft law were taken into account by the National Bank of Ukraine that has developed the document. The Law of Ukraine “On Financial Services and Financial Companies” was adopted  The Law of Ukraine “On Financial Services and Financial Companies” (draft №5065) was also adopted. It aims at becoming the basis for the legal regulation of the entire financial services market, regulation, and supervision of financial services market activities. Sanitary and epidemiological examination of extra complex cases of pesticides and agrochemicals At the end of the week, there was a meeting of the Commission for the State Sanitary and Epidemiological Examination of extra complex cases of pesticides and agrochemicals. It reviewed more than 100 registration materials for pesticides and agrochemicals. For the last month, 1968 conclusions of the state sanitary-epidemiological examination were issued, from which, 557 conclusions were issued in the last week. The EBA community thanks the State Service for Food and Consumer Protection for effective cooperation and prompt resolution of issues facing the business. Almost 200 CPPs were recommended for registration There was also a meeting of the Scientific and Expert Council on State Registration of Pesticides and Agrochemicals under the Ministry of Environment as a result of which almost 200 products were recommended for registration. We hope that next week will be just as productive of positive news for business.

Draft law №6055 removes this detrimental rule which imposes such unconditional restrictions. We are currently waiting for the President’s signature for this amendment to come into force on January 1, 2022.
