Application for intellectual property protection can be submitted online

  Starting from October 19, 2020, the State Customs Service of Ukraine has launched an updated register of intellectual property rights which continues reforming the system of protection of intellectual property rights when moving goods across the customs border of Ukraine, initiated by the adoption of the Law № 202-IX late last year. The update of the customs register was a successive step aimed at strengthening the protection of intellectual property rights by customs authorities in carrying out foreign economic activity. Thus, the important changes include the possibility to apply for registration of intellectual property rights in electronic form through a personal account on the Single Window portal. Previously, such an application could be submitted only in paper form. The application form itself has also been updated under the European prototype and includes the possibility to file several intellectual properties at once, with the ability to attach all the necessary additional materials. According to the representatives of the State Customs Service, until the objects from the old register are exhausted, it will operate in parallel with the new one. The procedure for registration in the customs register of intellectual property rights, which are protected following the law, has also been updated. The adopted changes, including those aimed at combating counterfeiting and piracy. Thus, customs officials now have clear instructions on how to establish that the goods are original, which in turn ensures the inadmissibility of importing counterfeit and pirated goods into Ukraine. These changes were adopted in the framework of the Ukraine-EU integration package, which introduces the basic principles of customs measures to protect intellectual property rights and requirements for procedural documents. Experts of the European Business Association have long been involved in the development of changes and provided proposals on the procedure for maintaining a custom register of intellectual property rights.
