Draft law on mobilization returned to the government for revision

  Yesterday, the Cabinet of Ministers of Ukraine withdrew the Draft Law On Amendments to Certain Legislative Acts of Ukraine on Improving Certain Issues of Mobilization, Military Registration, and Military Service (No. 10378) for further revision. The European Business Association welcomes this decision and hopes that the proposals to Draft Law No. 10378 previously submitted by the EBA will be considered. In particular, they relate to the delivery of summonses by the employer, updating of credentials, and responsibility for such updates, etc. According to the map of the document, what is planned to be changed in the document: to exclude the requirement for persons liable for military service to provide a place of residence when entering into an employment contract; to exclude the provisions on entering the register of debtors; to return the provision on granting deferral from mobilization and the right to dismissal to all persons with disabilities, including those of the third group; to exclude the deferral of employees of enterprises, institutions, and organizations of the Ministry of Defense of Ukraine, law enforcement agencies; to grant a deferment to persons enrolled in an internship; to return the provision on granting a deferral from mobilization for scientists and teachers, provided that they work at their main place of work at least 0.75 of the rate; to exclude the provision on empowering local executive authorities to make decisions on granting deferment from mobilization to persons liable for military service; to remove the provision requiring citizens to clarify their credentials within 20 days from the date of the mobilization extension; to exclude summonses via e-mail, etc. We also emphasize the need to withdraw the draft law On Amendments to the Code of Ukraine on Administrative Offenses and the Criminal Code of Ukraine on Strengthening Responsibility for Military Offenses No. 10379, as the entire package of legislative initiatives on mobilization needs to be thoroughly revised. At the same time, the community representatives are ready to join the development of amendments to the draft law if necessary!
