Protection of consumer rights online

25/ 10/ 2022
Author: Oleksiy Hrachov, attorney at Dynasty Law & Investment Modern business related to offline retail or wholesale, looking at the dynamics of online sales, sooner or later will resort to electronic commerce. Of course, buying and selling online has its own characteristics, but in any case, the parties to a transaction concluded on the Internet have the same rights and obligations as those who concluded it in the real world. However, despite the fact that the Law of Ukraine On the Protection of Consumer Rights applies equally to offline and online trading platforms, the rights and interests of participants have recently been difficult to protect due to this. ✅ First of all, many online stores do not contain information sufficient to identify the manufacturer of the products in order to file a claim in case of product defects. Online sellers themselves often do not publish information about themselves at all and leave a note that they are not responsible for the defects of the purchased item. ✅ Secondly, the vast majority of sites selling imported goods do not contain information about them in Ukrainian, or the translation has serious flaws. ✅ Thirdly, the offer of some online stores narrows the rights of consumers, which is contrary to the current legislation. ✅ Fourthly, few online sites provide electronic documents to confirm the concluded sales contract. This results in significant complications during the return of paid funds. But these are just some of the nuances of consumer rights protection that both consumers and business owners have to face. Dynasty Law & Investment will gladly provide legal support for the creation of your online store or help protect your rights as a buyer on the counterpartys online platform.
