The European Business Association welcomes the Government’s decision to reinstate the salary criterion among the criteria for determining critically important enterprises

  In September 2025, by Order of the Ministry of Economy No. 471, indicators related to wage levels were removed from the Criteria for Determining Critically Important Enterprises. The business community drew attention to the fact that the salary criterion is an important element of the system that encourages official and competitive remuneration, supports the de-shadowing of the economy, and contributes to preserving tax revenues for the state budget. Moreover, this criterion makes it possible to distinguish socially responsible employers who invest in their workforce, provide above-average market salaries and, accordingly, make a significant contribution to the payment of personal income tax, the military levy and the unified social contribution. For many enterprises, particularly in high-tech sectors and management companies, the salary indicator is also an important tool for retaining key and highly qualified personnel under martial law. Taking into account the position of its member companies, on 8 October 2025 the European Business Association addressed the Ministry of Economy, Environment and Agriculture of Ukraine with an official letter outlining the relevant arguments in favour of reinstating the salary criterion. This issue was also discussed on 28 October 2025 during a meeting with the Minister of Economy, Environment and Agriculture of Ukraine, Oleksii Sobolev. The European Business Association positively notes that the Ministry took into account the arguments of the business community and formalised the relevant changes in Order No. 3650 dated 22 December 2025, which was registered with the Ministry of Justice of Ukraine on 29 December 2025 under No. 1953/45359 and entered into force following its official publication. The adopted decision, in particular, provides for the reinstatement of the salary criterion, allowing the average wage level to be taken into account when determining enterprises as critically important for sectors of the national economy. The European Business Association sincerely thanks the Ministry of Economy, Environment and Agriculture of Ukraine and Minister Oleksii Sobolev for their openness to dialogue, balanced approach and willingness to consider the position of the business community. The ЕВА welcomes this decision and views it as an important step towards supporting responsible business, preserving jobs, de-shadowing the economy and strengthening the resilience of Ukraine’s economy.
