Ukraine plans to update 23 building codes and 130 construction standards

  On October 26, representatives of the European Business Association had the opportunity to talk with Olena Shulyak, Deputy Chair of the VRU Committee on Public Administration, Local Self-Government, Regional Development and Urban Development, and Natalia Kozlovska, Deputy Minister for Communities and Territories Development of Ukraine. During the meeting, we discussed the latest steps in reforming the field of urban development in Ukraine and further plans of public authorities in this regard. In the context of improving the regulation in construction, we can talk about the adoption of Law №156-IX on Building Norms and the start of updating the State Building Norms (DBN). The budget for 2021 included UAH 56 million for updating the DBN which would guarantee their modernization and harmonization with the real needs of the business. The result will be the update of 23 DBNs and the adoption of about 130 standards in the field of construction by the end of this year. Among other priority areas in the field of construction, the representatives of the Parliament and the Government mentioned the introduction of modern European rules for building materials that should be energy-efficient and safe for consumers. In this regard, it is now important to adopt a number of bylaws and create the infrastructure for the implementation of quality procedures for conformity assessment and state control over the quality of construction materials. The priority of public authorities is also the digitalization of the industry which will reduce the level of corruption, make the procedures for obtaining a building permit as fast and transparent as possible. Also, it was extremely important for the business to hear the position of the representative of the Ministry of Regional Development on the importance of further reforming the system of architectural and construction control. After all, the situation when in December of last year before its liquidation, the State Architectural and Construction Inspectorate of Ukraine refused 53% of applications from the companies. Therefore, the EBA community hopes that the cooperation of business with the newly created State Inspectorate of Architecture and Urban Planning of Ukraine (DIAM) will be more effective. For this, there should be the replacement of the DABI monopoly with the institute of independent auditors, the renewal of the supervisory system, and digitalization of the construction. Also, representatives of the Parliament and the Ministry of Regional Development stressed that it is important for further reform of urban planning to adopt Draft Law 5655 on reforming urban development, which is currently being prepared for second reading in the relevant VRU Committee. This document aims to reform state regulation in the field of urban planning, namely, by reducing corruption risks when issuing permits, building a transparent and effective system of state control over urban planning, etc. Therefore, government officials asked the business community to analyze the provisions of Draft Law 5655 and, if necessary, provide the necessary suggestions and comments. The European Business Association is grateful to the representatives of the VRU Committee and the Ministry of Communities and Territorial Development of Ukraine for a constructive meeting.
