Ukraine Introduces Criminal Liability for Illegal Border Crossings

  On 18 October 2018, the Ukrainian parliament adopted Law No. 7017 On Amending Criminal Code with regard to Liability for Illegal Crossing of State Border, which makes it a criminal offence to cross the state border of Ukraine outside official crossing points, without travel documents or by using forged documents for certain categories of persons. The affected categories of persons include (i) persons previously prohibited from entering Ukraine, (ii) military or law enforcement personnel of an aggressor state (i.e. the Russian Federation) or (iii) any person having an intent to harm interests of Ukraine. According to this law, the above actions will be punishable by imprisonment for up to three years. Where such actions are repeated or perpetrated by a group, the imprisonment may reach up to five years. The same actions coupled with violence or using arms will be punishable by imprisonment for up to eight years. The law came into effect on 10 November 2018.
