The Court Refused to Lift the Anti-Dumping Duties Imposed on Import of Gas-Concrete Blocks from the Republic of Belarus

  On 2 March 2021, District Administrative Court of Kyiv refused Belarusian manufacturers of gas-concrete blocks – Republican manufacturing and trade unitary enterprise Management company of Belarusian cement company holding and the importer BK Comfort-Bud LTD LLC – to lift the anti-dumping duties imposed on the commodities import to Ukraine. Ilyashev & Partners law firm protected lawful interests of members of All-Ukrainian association of autoclaved gas-concrete blocks manufactures as a third party to this case. Thus, the court upheld Resolution of the Interdepartmental Commission on International Trade dated 21 February 2020 No. AD-437/2020/4411-03 on imposing final anti-dumping measures on import to Ukraine of gas-concrete blocks that originate from the Republic of Belarus, which imposed the final anti-dumping duty at 34.19%. During the period of 2014-2017, the share of Belarusian import in the total import increased by as much as 94%. Measures were taken to restore fair competition on the market, preserving jobs and avoiding bankruptcy of the relevant enterprises. The project was endorsed by Partner Olena Omelchenko, Counsel Valeriia Gudiy and Attorney at Law Oleksiy Gorbatyuk.

Thus, the court upheld Resolution of the Interdepartmental Commission on International Trade dated 21 February 2020 No. AD-437/2020/4411-03 on imposing final anti-dumping measures on import to Ukraine of gas-concrete blocks that originate from the Republic of Belarus, which imposed the final anti-dumping duty at 34.19%.
