“Catch Me If You Can”

11/ 10/ 2022
Author: Oleksandr Bragin, attorney at Dynasty Law & Investment Driving on the roads of Ukraine, you can observe not only the picturesque landscapes of our country, but also the absence of road signs that indicate the distance to populated areas and the direction. Their absence is fully justified, because from the beginning of the full-scale invasion of the Russian Federation into Ukraine, it was necessary to create as many obstacles as possible for the advancement and orientation of the invaders on the territory of our state. In connection with this, in February, not only physical signs indicating the direction and distance to settlements, but also those indicating the beginning and end of settlements disappeared from the roads. But such circumstances have another side, which directly affects the rights and obligations of road users. As a general rule, the movement of vehicles in populated areas is allowed at a speed of no more than 50 km/h (clause 12.4. of the Traffic Code), and outside populated areas, on all roads and roads passing through populated areas marked with sign 5.51 (A road sign that indicates the beginning of a settlement and is made on a blue background), traffic is allowed at a speed of no more than 90 km/h, 110 km/h if the road has separate carriageways that are separated from each other by a dividing strip (clause 12.6 Traffic regulations). Also, the traffic rules define a settlement, that is, a built-up area, entrances to and exits from which are marked by road signs that indicate the beginning and end of the settlement and are made on a blue or white background (5.49, 5.50, 5.51, 5.52). In some settlements, the mentioned road signs were restored, and in some they are still missing. This circumstance deprives drivers of the opportunity to correctly determine from what moment and at what speed the vehicle should move. The given situation is twofold. On the one hand, violators of traffic rules have the opportunity to avoid punishment, and on the other hand, there are grounds for manipulation by representatives of law enforcement agencies that monitor compliance with traffic rules. The lawyers of Dynasty Law & Investment will help you understand the intricacies of the current legislation and avoid being caught by law enforcement agencies.
