Cancellation of the rules for traveling outside the place of residence during martial law with subsequent sending for revision

  As we mentioned before, on 28 June 2022, the General Staff of the Armed Forces of Ukraine approved the Procedure for granting permit to citizens of Ukraine who are included in military record to travel outside their place of residence (place of stay) starting from the moment of mobilization and during martial law (the Procedure). Among other things, the Procedure set forth the need to obtain a permit from the military office if a person intends to travel outside the place of residence. To obtain the permit the person had to meet certain criteria and respective documents. It should be noted that the provision prohibiting conscripts and reservists from travelling outside the place of residence is grounded on a similar provision of the Law of Ukraine On Military Duty and Military Service, which has been in effect since 1992. On 06 July 2022, the Head of the General Staff of the Armed Forces of Ukraine cancelled the Procedure and sent it for revision. Moreover, the General Staff of the Armed Forces of Ukraine noted that the updated document will be developed on the basis of changes to the laws of Ukraine and subordinate legal acts that regulate the movement of citizens under martial law. Current legislation does not take into account today`s realities and does not provide effective mobilization mechanisms. On 06 July 2022, the Head of the General Staff of the Armed Forces of Ukraine cancelled the Procedure and sent it for revision.

Moreover, the General Staff of the Armed Forces of Ukraine noted that “the updated document will be developed on the basis of changes to the laws of Ukraine and subordinate legal acts that regulate the movement of citizens under martial law. Current legislation does not take into account today`s realities and does not provide effective mobilization mechanisms.”
