EBA Odesa Legal School with ADVISERS Law Company Module 3: “We submit a claim: step-by-step instructions, document templates”

  On August 26, 2021, the third module of the EBA Odesa Legal School with ADVISERS LAW COMPANY was held. Together with Maria Belogub, Legal Adviser, Lawyer, Head of Litigation of company we reviewed the topic of claims and focused in more detail on step-by-step instructions and possible document templates. In particular, in Block 1 focused on the Soft Claim and the Claim as two effective tools for pre-trial dispute resolution. In block 2, we learned the algorithms of actions for drawing up and filing a claim. And in block 3 they talked about the calculation of the amount of the claim, examples and case law. Thus, it should be noted that when preparing a claim, the lawyer already assesses the winningness of the dispute and significantly reduces the time frame for further preparation of the statement of claim to the court. So we will leave useful expert advice on filing claims here: Remember that pre-trial settlement is not required. Check if you have really violated the right of the counterparty. To do this, prepare as before writing a claim. Make sure that the circumstances referred to by the applicant do not fall under the exclusion of liability under the law, the contract. Determine if your company has the ability to satisfy a well-founded claim. Do not overestimate the formal shortcomings of the claim if a violation occurs. Respond in a timely manner, depending on your protection strategy. Check compliance with the statute of limitations. Independently calculate the amount of the claim and compare with what was provided by the applicant.
