Strengthening environmental control is unlikely to solve the problem of waste in Ukraine

  This was stated on August 10 by representatives of the European Business Association during a meeting with representatives of the Specialized Environmental Prosecutors Office of the Prosecutor General, when the issue of waste management was discussed. Among the main challenges in this regard, the participants named illegal landfills, non-compliance of waste processing companies with their declared capacity, problems with receiving permits. Strengthening environmental control in the absence of effective legislation will primarily hit law-abiding businesses, which will have to accompany inspectors during endless inspections. In fact, Ukraine is now in a transitional stage, when the current waste legislation is outdated, and the new draft law is still being prepared for a second reading. Meanwhile, the business independently implements numerous projects for separate collection, sorting, and safe disposal of waste, as well as uses secondary raw materials instead of exhaustible natural resources. That is why the European Business Association calls for a comprehensive approach to solving problems in waste management, because, unfortunately, so far, the business does not have total trust in the authorities, and therefore is wary of strengthening the powers so that it does not turn into abuse. Thus, according to EBA member companies, in recent years the number of unfounded allegations from individuals and NGOs about violations of environmental legislation by some companies has increased. However, most of these allegations do not contain the facts and circumstances of the violation at all and are based solely on the applicants assumptions. All this leads to an excessive administrative burden on business due to the increase in the number of unscheduled environmental inspections, as well as a significant overload of law enforcement agencies due to the need to consider and respond to all these applications. Therefore, it would also be appropriate to include in draft Law №3091 on state control a list of clear requirements for such statements and their proper reasoning.
