New law on business trips of home-based and remote employees

  On 2 May 2025, the Law of Ukraine On Amendments to the Labor Code of Ukraine on Improving Legal Regulation of Certain Issues of Home-Based and Remote Work dated 27 March 2025 No.4339-IX (Law) entered into force. It regulates business trips of home-based and remote employees, and also provides for favorable working conditions for parents whose children study remotely in secondary schools. Key changes Specific terms for business trips of home-based and remote employees may be established in their employment agreements. If a remote employee is to be sent on a business trip, they are obliged to notify the employer of their current location. For a remote employee, the point of departure and return from a business trip will be determined by the employer in agreement with the employee and will be specified in the order about the business trip. With the employers consent, an employee may switch to working from home or remotely for the period when the employees child under the age of 14 is studying remotely in a secondary school. Recommendations We recommend that employers review the terms of employment agreements with their home-based or remote employees to consider the above changes.
