New employee booking procedure: answers to the most frequently asked questions

  On February 10, the European Business Association met with Serhiy Smetanko, Director of the Department of Security and Defense Economics at the Ministry of Economy of Ukraine. At the meeting, we discussed the urgent issues related to the new procedure for booking employees liable for military service, as provided by CMU Resolution No.76. As of January 31, a new algorithm for booking persons liable for military service entered into force for enterprises (without a mobilization task), which allows reserving up to 50% of employees liable for military service. How can a company book its employees during the mobilization period? The company check if it meets the criteria for booking and the relevant department (the Body) or regional military administration (RMA) through which the booking request will be made. The company submits to the Body or RMA a package of documents that confirm the companys compliance with three criteria. The company receives the number and date of the decision of the Body or RMA on categorizing the company in question as critical. The company submits to the same Body or RMA a list of conscripts that they ask to book together with a letter of justification, a certificate of the number of conscripts. The Body or RMA coordinates the booking of the companys employees with the General Staff. After the adoption of a positive decision by the General Staff, the Ministry of Economy issues an order on the reservation of employees of the company and informs the Body or RMA about it. The company receives the booking order and within 5 days informs the Territorial Сenters for Recruitment and Social Support. They will place booked employees on special military registration. We would like to draw your attention to the fact that the criteria for determining companies, institutions and organizations as critical to the functioning of the economy and the livelihoods of the population will be shortly approved by an order of the Ministry of Economy. It is not possible to apply for several criteria at once or to different authorities - all applications will be checked by EDRPOU to prevent duplication. The State Tax Service has provided clarifications to its departments on the issuance of tax payment certificates to confirm the right of a company to book employees. And they have already started issuing them. Also, it is possible to submit certificates for obtaining critical enterprise status electronically. Currently, employees who have already been mobilized before are not counted to 100% of the employees liable for military service. However, women liable for military service whose mobilization is voluntary should be included in the total number of persons liable for military service. Lawyers, HR or other representatives of the company may update the military records in the Territorial Сenters for Recruitment and Social Support, it does not have to be a person liable for military service. Employees who have not performed military service but are liable for military service can also be booked. The companys certificate of the average salary can be drafted in any form and must be submitted for the entire legal entity.  If the company has a complex structure and is represented in different regions, the average salary is calculated at the place of registration. No additional certificate from the State Statistics Service is required to confirm the average salary in the region. There is no separate procedure for individual entrepreneurs; FOPs can apply for a deferral using the same procedure. The inclusion of employees who has a deficit military speciality and liable for military service, but it increases the chances of having individual employees or the entire list refused. It is necessary to communicate with the General Staff regarding such employees. However, the head of the company and the deputy head may be included in the booking list, even if they have a deficit military speciality.
