New rules for the introduction of packaged products may be postponed

  The transitional period for the introduction of packaged products, which does not meet the requirements of paragraph 1 of the Order № 969 On the establishment of metrological requirements for packaged goods of the Mineconomy dated July 5, 2017, can be extended by 2 years. This is provided for in Order №462 On Amendments to Clause 3 of the Order of the Mineconomy of the Mineconomy dated March 5, 2021. At the same time, the Ministry of Justice must register the document in order for it to take effect. The European Business Association welcomes this decision. The EBA is grateful to the Ministry of Economy for supporting and developing the relevant order. At the same time, the business community urges the Ministry of Justice to register Order №462 as soon as possible. It will be recalled that on March 5, 2021, food producers should switch to a new format for applying the information to the packaging of packaged goods as required by Order №969 of the Ministry of Economy. However, due to the fact that in 2020 the consumption of certain categories of food products decreased significantly, and, accordingly, their sales fell, the companies formed significant stocks of packaging materials. Thus, companies would have to discard packaged food and packaging materials in significant quantities only because of the non-compliance of some minor labeling components with the new rules. Losses for business could be significant, but also unjustified because it is only a label that does not affect the safety and quality of the product itself. According to estimates of EBA member companies, the costs can reach several million hryvnias for individual companies. This creates unnecessary problems for businesses, which already encounter difficulties given the deteriorating economic situation in the country and the growing challenges posed by the COVID-19 pandemic. Besides, companies faced the impossibility of adjusting production lines in a timely manner under quarantine restrictions. Thus, it is problematic to check the correct setting of the criterion of the number of packaged goods in one package and its deviation from the nominal value, which is mandatory under the same Order of the Mineconomy. The companies reported that their facilities located in other countries do not provide guarantees of arrival in Ukraine until the end of the transition period to check the operation of the equipment.
