New quarantine restrictions from November 1: what should business know?

  Due to the deteriorating epidemic situation and the growing number of COVID-19 cases, quarantine restrictions are tightened in Kyiv from November 1. It is likely that the red level of epidemic danger will soon be introduced across the country. Thus, the European Business Association met with experts from the State Service of Ukraine on Food Safety and Consumer Protection to address the frequently asked questions from businesses about new rules of working in the red zone. Below are the answers and explanations divided by topic. Office Safety  Given the critical situation with COVID-19, the red zone provides for strict restrictions on the work of enterprises of various forms of ownership. However, there will be exemptions for vaccinated persons, persons who have recovered from COVID-19 within the last 180 days or have a negative result of the PCR or antigen test done within 72 hours by a certified laboratory. If workers have contraindications to vaccination, provided they have a certificate from their family doctor, they can continue to work if they have a negative PCR or antigen test. If there is only one dose of the vaccine, work is allowed in the yellow and orange zones. In the red zone, a person with one dose of the vaccine is obliged to test every 72 hours until he/she receives the second dose. The relevant requirements are established by CMU Resolution №1236 of December 9, 2020. Decisions of local authorities  Representatives of the State Service of Ukraine on Food Safety and Consumer Protection confirmed that local commissions on technogenic and ecological safety may impose additional restrictions that may go beyond Resolution №1236 to combat the spread of COVID-19. In this case, the requirements of local authorities will prevail over the decision of the Cabinet and are binding. Work of business entities Critical infrastructure companies are an exception – their workers can work at the spot without having the above documents or presenting them unless otherwise established by local commissions on technogenic and ecological safety. However, the mask regime, the antiseptics, and the social distancing are mandatory to comply with. Businesses are encouraged to check both the availability and validity of vaccination certificates because liability is provided for a forged certificate found during the inspection. QR codes can be scanned and validated using the Diia application. The operation of the malls is allowed in the red zone provided that they meet all the necessary requirements. The so-called entrance for document verification should be located on the territory of the mall. At the same time, shops having a separate area on the territory of the mall should additionally check their visitors. The list of occupations obligatory to the mandatory vaccination can be further expanded. Such a decision should be introduced by the Order of the Ministry of Health. We will recall that as of today obligatory vaccination concerns the following three groups: employees of the central executive bodies and their territorial bodies; local state administrations and their structural subdivisions; educational institutions and research institutions regardless of the type and form of ownership. Work of transport  Travel in public transport, namely in Kyiv, is allowed with a yellow certificate. Similarly, long-distance regional connections (within Kyiv are Kyiv region) are allowed with whichever of the two types of certificates, a recovery document, or a negative test. Compliance with these requirements will be carried out with the help of selective inspection of both carriers and passengers. These requirements apply to public transportt. Foreign certificates and QR-codes Certificates issued to foreigners or citizens of Ukraine abroad are valid as they can be verified with QR code scanning. It will be recalled that verification of certificates using a QR code is recommended to identify the originality of the presented document. Some documents currently issued without a QR code, such as the recovery certificate and medical contraindications to vaccination, will soon be modified to include QR codes. The possibility of adding them to the Diia application is also being considered. Note that the document with the results of laboratory testing must also contain a QR code to verify its validity. Inspections The inspections will start on Monday and will be carried out by 40 mobile groups with priority given to educational institutions and preschools; entities reported by hotline callers; entities where there is a mass concentration of people. If violations are detected, warnings and fines in the amount of UAH 17,000 for FOPs and UAH 34,000 for LLCs may be applied.
