LCF won litigation with PJSC “Ukrainian Railways”

  The team of the LCF Law Group won a long-awaited victory in a lawsuit with PJSC “Ukrainian Railways” and proved the legality of the claims of First Ukrainian International Bank to recover UAH 500 million. Thus, the Supreme Court confirmed the obligation of PJSC “Ukrainian Railways” to return the loan to the bank, which was received by SE “Donetsk Railway”. PJSC “Ukrainian Railways”, which merged all the assets of the railway companies after the reorganization in 2015, denied succession to the obligations and refused to repay the loan debts. LCF lawyers were proving the existence of state-owned liabilities in the courts since 2016, and have played a significant role in shaping case law on this issue. In 2020, the Supreme Court resolved an exclusive legal issue and established the fact of succession of PJSC “Ukrainian Railways” for all debts. Managing partner Anna Ogrenchuk, partner, head of bankruptcy and restructuring practice Olena Volyanska and senior associats Yuriy Didenko and Denys Sperov worked on the project.
