EBA Healthcare Committee joined the Supplier Forum

  On February 28, 2024, on the occasion of the beginning of the procurement cycle 2024, a Supplier Forum was held, organized by the State Enterprise Medical Procurement of Ukraine (SE MPU). The event was attended by representatives of the EBA Healthcare Committee. During her participation in the discussion panel, EBA Healthcare Committee Manager Olena Sytenok voiced an urgent issue that needs to be addressed, namely, ensuring a mechanism for the refund of SE MPUs VAT expenses. Unfortunately, the provision that allowed the Ministry of Health to carry out centralized procurement of medicines without VAT in 2023 was not extended for 2024. Now the problem with VAT concerns both the contracts that were concluded earlier and the efficiency of procurement in 2024. The EBA Committee calls on the state authorities to resolve this issue to ensure that there is no significant reduction in state budget funds for the procurement of medicines for patients in 2024 by the established need. The EBA Committee also draws attention to the issue of extending the obligation of public authorities to procure under-managed access agreements (MAA) to provide patients with innovative medicines they need. The Committee looks forward to the resumption of the negotiation process in 2024 and its effectiveness for the relevant INNs that have recommendations for negotiating MAAs based on the results of the medical technology assessment. During the event, the EBA representative drew the attention of the management of the SE MPU to certain expectations of the Association regarding the further development of the procurement sector, in particular, in the context of the procurement of medical equipment. The importance of non-price criteria for the procurement of expensive medical equipment is one of the most important issues today. Not only the initial cost should be taken into account, but also the cost of the equipments life cycle, the availability of service, and the warehouse of spare parts in Ukraine. These factors can change the service life of the equipment. The smooth functioning of the Prozorro Market platform, which is mandatory for procurement of medicines from the National List of Essential Medicines starting from March 1, 2024, is important to ensure transparency and equal access to procurement for all suppliers. In addition, the absence of problems directly affects the ability of healthcare facilities to choose all available medicines under the relevant INN. On the eve of the Forum, the companies informed the EBA Committee about several technical problems, such as the inability to search for certain combination medicines under both INNs that are part of the respective medicines; inability to search by trade names; different search results for the same medicines on different e-platforms by healthcare facilities; technical errors in entering trade names of medicines into the platform, etc. The EBA Committee hopes that all technical obstacles will be resolved, which would ensure exclusively transparent procurement of medicines by healthcare facilities based on the Prozorro Market platform and a quick response to requests from business/healthcare facilities by the SE MPU in case of any problems in the future. Additionally, in the context of procurement, the EBA Committee draws attention to the need to develop a mechanism for selecting a particular medical technology for procurement by the results and recommendations of the abbreviated medical technology assessment (MAT) posted on the website of the State Enterprise State Expert Center of the Ministry of Health of Ukraine. This would indicate the integration of the results of the work carried out within the framework of the MAT into the procurement process, and would also contribute to the rational use of budget funds. Also, the issue that has already been initiated earlier - the application of the reimbursement mechanism to certain INNs from the list currently defined for centralized procurement - requires further study of the possibilities and implementation in practice. The EBA thanks the SE Medical Procurement of Ukraine for its open position and the dialogue that took place. The EBA Committee looks forward to regular interaction, which would facilitate timely feedback from both parties and effective planning of activities by the business.
