Innovations in the Area of Procurement of Medicines for Budgetary Funds Have Been Discussed in Kyiv

  On September 28th, 2017 Kyiv hosted a workshop Public Procurement of Medicines organized by Legal Alliance Company together with Newtend, the official platform of PROZORRO. The event was attended by more than 70 representatives of the pharmaceutical market, non-governmental organizations, as well as specialized mass media. Participants of the event discussed issues related to procurement legislation and its current problems, and also learned more about the features of PROZORRO electronic procurement system. Dmytro Aleshko, partner at Legal Alliance Company, and Alexander Bondar, senior associate, spoke during the first session of the event dedicated to legal issues of procurement of medicines for budgetary funds, as well as to the procurement system reform. It should be mentioned that by now Dmytro and Alexander have been consulting the UNDP project in Ukraine on the development of a policy in the area of public procurement of medicines and medical products for three years. Dmytro Aleshko, talking about the reform of the system of public procurement of medicines and medical products and the establishment of the Central Procurement Organization, dwelt on the stages of reforming the mechanisms of public procurement in this area and stressed Only the first step has been taken in the sphere of reforming public procurement of medicines and medical products. The legislation requires amending, including in order to enable the negotiation procedure, payment of service charges to the Central Procurement Organization, as well as to make changes in the by-laws requirements for the nomenclature formation. Alexander Bondar paid attention to the practice of the Antimonopoly Committee of Ukraine (AMCU) in the sphere of appealing the procurement of medicines procedures. In particular, Alexander discussed the appealing procedure with the participants and gave common examples of errors both by the customer and by participants in public procurement, when drafting tender documents and tender bids. The speaker also focused on the classical discriminatory requirements established by the customers to confirm the participants compliance with qualifying criteria, and spoke about the AMCU position based on the analysed recent complaints. Alexander Bondar stressed The mechanism of appealing the procurement procedures in the AMCU is the legal tool that can allow participants to protect their violated rights and legitimate interests in a timely manner. The second part of the event saw presentations by Iryna Gorlova, SMD CEO, Sergii Yaroshenko, NEWTEND Support Manager, and Tetiana Kolesnyk, public procurement consultant. Iryna Gorlova spoke about the project of monitoring procurement for budgetary funds, their dynamics and the role of PROZORRO platform in ensuring transparency of the procurement system. Iryna Gorlova concluded This is a unique project for the study of the pharmaceutical market in Ukraine, which has been in operation since 2013. The project is based on contracts concluded upon bidding, each of which is processed manually, and information is entered into the database. Thus, you get a tool to study all aspects of procurement for public funds at all levels. In turn, we are ready to demonstrate the options of the program. Sergii Yaroshenko drew attention of the participants to the existing ways to win the tender if there are bad-faith participants taking part in it. It is possible to counteract them using honest methods. Do not succumb to their tricks and unreasonably reduce your bid. In addition, it is necessary to determine the minimum threshold for the bid. However, if the preventive measures did not bring any result then there is an effective tool for restoring justice - an appeal, he said. Tetiana Kolesnyk, consultant on public procurement, made a presentation on the advantages and disadvantages of PROZORRO system. She spoke about the registration process and work on electronic platforms. Tetiana described in detail the practical aspects of pre-threshold and super-threshold procurement, focusing on the preparation of the tender bid. There are processes that are inevitable, Dmytro Aleshko commented on the results of the workshop. - Procurement for budgetary funds are becoming more civilized. I hope that at a similar workshop in two years we will be able to talk about the first success of the Central Procurement Organization. No one but us will do it all. A lot of work is ahead.
