EBA calls for the signing of the law to strengthen the protection of bona fide purchaser’ rights

  The European Business Association has expressed its support for the adoption of Law No. 12089, which regulates the recovery of property from bona fide purchasers and introduces compensatory mechanisms to reimburse the market value of such property. As a reminder, this law was adopted by the Verkhovna Rada of Ukraine on 12 March and has been submitted for the Presidents signature. The business community supports this initiative, which aims to enhance the rights of bona fide purchasers. The law limits the timeframe for reviewing the legality of land transfers, preventing owners from losing assets due to past errors or inaccuracies. This will help strengthen legal stability and protect investments. EBA experts believe that implementing this law will have a positive impact, particularly by: Improving legal enforcement in cases involving property recovery from bona fide purchasers; Addressing compensation issues for bona fide purchasers when property is reclaimed by the state or local communities, ensuring that further damages are recovered from those responsible; Strengthening legal safeguards for bona fide purchasers in cases where property exits state or municipal ownership. Considering these arguments, the EBA hopes that the law will be signed by the President without delay.
