EBA continues to support initiatives aimed at solving the problems of importing prohibited boilers and the need for all players to comply with the requirements of the legislation

  Since August 29, 2022, the introduction of non-energy-efficient turbocharged boilers into circulation has been prohibited in Ukraine. The relevant norm was established by the Technical Regulation on ecodesign requirements for space heaters,approved by the Government Decree in December 2019, which was developed based on the relevant Regulation of the European Union. At the same time, certain unscrupulous business entities continue to massively import prohibited boilers,which harms ordinary consumers, the state, and law-abiding businesses that comply with the requirements of the legislation. Non-energy-efficient boilers consume more energy resources. In particular, according to the calculations of experts of the Consumer Electronics Committee of the European Business Association, the annual overconsumption of gas by one non-energy-efficient boiler compared to an energy-efficient one is 580 m3 per year. The service life of the boiler is at least 10 years, and tens of thousands of such boilers are imported every year. Ukrainian consumers and the state, which currently partially subsidizes the cost of gas for the population, have to pay for all this gas. The state, in addition to resources for subsidizing the cost of overused gas, also loses underpaid taxes and customs payments, because non-energy-efficient boilers cost a little less. Moreover, given that the import of such boilers is currently prohibited, there are risks that the sale and import of such boilers will be mostly carried out without paying taxes and fees at all, which will lead to even greater budget losses. Law-abiding businesses that comply with the requirements of the legislation suffer from unfair competition in such conditions and have already lost a significant share of the market. Therefore, the ЕВА continues to support initiatives aimed at solving the problems of importing prohibited boilers and the need for all players to comply with the requirements of the legislation. In particular, last week, a Memorandum was signed with the company Dega Partners, which is one of the legal advisors of the ЕВАs Committee on Consumer Electronics, on cooperation to solve the problem of importing prohibited, non-energy-efficient space heaters into Ukraine. Thus, the parties plan to draw additional attention of representatives of state bodies to the need to solve this problem, as well as try to promote the termination of the supply (import, sale, commissioning) of fuel boiler space heaters (turbocharged boilers) that do not meet the requirements of the Technical Regulations.
