Business asks the Parliament to fix the situation with involuntary non-compliance with deadlines for tax declarations’ registration due to cyber-attacks

  As you know, a massive cyber attack took place on June 27, 2017, which caused a number of negative consequences for business, in particular, led to significant difficulties in registering tax invoices and adjustments made during the period from June 1 to 15, this year. In addition, there is currently a risk that companies will not be able to register their tax invoices in a timely manner not only during the specified period, but also for the entire June, as it takes a long time to find, install, and configure the enterprise systems interaction with the new software. Since the current version of the Tax Code of Ukraine provides for the application of fines for late registration of tax invoices, even in the absence of the fault of the payer, the only effective way is to amend the Code. At present, the Ministry of Finance of Ukraine together with the State Fiscal Service of Ukraine has developed, and the Government has approved a draft law amending the Code, which in the near future should be registered with the Verkhovna Rada of Ukraine. This initiative will allow not to apply to taxpayers penalties for violating the timing of registration of tax invoices or adjustments calculations that were made from June 1 to 15, provided that they are registered no later than July 15, 2017. In this regard, the representatives of the Association express their support and hope for the adoption of the draft Law On Amendments to the Tax Code of Ukraine regarding the registration of tax invoices and / or calculations of adjustments to tax bills in the Unified Register of Tax Bills as soon as possible. At the same time, taking into account that a virus attack has involved a large number of enterprises and the likelihood that such interference with computer networks may occur in the future, the Association emphasizes the need for a systematic solution to this problem. In particular, we see the following important steps: To prepare a general tax advice regarding the taxpayers action algorithm to address the unintentional violation of the deadlines for the registration of tax invoices for the entire June due to the cyber-attack. To establish the work and full functionality of the e-tax office, which can become an alternative to the software M.E.doc.. Legislative resolution of potential similar problems that may arise due to the repeated penetration of malicious crypters into computers. Members of the Association are grateful to the Ministry of Finance of Ukraine and the State Fiscal Service for understanding the situation of taxpayers and their proactive steps to minimize the negative effects of the virus for business and look forward to the adoption of the relevant draft Law by the peoples deputies of Ukraine as soon as possible.
