EBA proposes amendments to draft freight wagon repair regulations

The Logistics Committee of the European Business Association has prepared proposals and clarifications to the draft Order of the Ministry for Development of Communities and Territories of Ukraine introducing amendments to the Procedure for Freight Wagon Repairs. Among the Committee’s key proposals are: retaining the repair contractor’s identification number to ensure traceability of completed works; ensuring the independence of the specialised organisation authorised to carry out diagnostic, repair and registration operations; introducing a six-month transition period before the amendments enter into force; clarifying terminology and introducing other technical amendments. The business community emphasises that the proposed changes should contribute to greater transparency of repair works, proper control over the technical condition of wagons, and the stable operation of the freight transportation market. In addition, member companies of the Logistics Committee call for consideration of abolishing the maximum service life limits for freight wagons. In the view of the business community, the possibility of continued operation of a wagon should be determined not solely on the basis of the manufacturer’s designated service life, but primarily with due regard to its actual technical condition, the results of diagnostic procedures, and the availability of residual service life. The Association notes that such an approach is consistent with international practice. In particular, in EU countries and the United States, the key criterion for the continued operation of wagons is their technical condition. At the same time, the current approach in Ukraine may lead to additional increases in logistics costs, particularly amid the challenging economic environment. The business community remains open to discussing the proposed amendments and recommendations in order to ensure the stability of freight transportation.
