Pre-trial investigation “in hot pursuit” and “countering cyberattacks”

  Author: Violetta Fedorko, Dynasty Law & Investment Lawyer The President of Ukraine signed the Law “On Amendments to the CPC of Ukraine” and the Law “On Electronic Communications” to Increase the Effectiveness of Pre-Trial Investigations “on Hot Tracks” and Counteraction to Cyberattacks ”under Registered №2137 – IX of March 22, 2022. The changes introduced by this Law should promote a rapid, comprehensive and impartial investigation of criminal proceedings, improve the response of law enforcement agencies to criminal offenses and detain those who committed them, including during martial law, in order to: ✅ prevention of loss, destruction or change over time of information contained in computer systems - introduced a new measure of security in criminal proceedings - urgent preservation of information and added new terms: computer data and computer system ; ✅ research of information to clarify the situation related to criminal proceedings - changed the amount of classified information (for personal data); ✅ strengthening the possibility of pre-trial investigation into the opening of cases in hot pursuit - introduced a new investigative / investigative action - taking evidence of technical means and devices that have the functions of photo and video, which was carried out exclusively in public places; ✅ closing gaps of gaps in the peculiarities of computer data review - brought to modern realities and terminologically updated the procedure for implementing the decision to allow the search of computers (their parts) or mobile devices; ✅ prohibition of blocking any activity of a person whose computer systems are temporarily seized - if possible, such a person will be provided with a copy of the information contained in these systems (if such copying does not violate the procedure established by law). Given the war in Ukraine on two fronts, one on the real battlefield and the other in the information space, and given the systematic cyber attacks and misinformation by the aggressor country, the changes introduced by this law will not only reduce the level of crime and its impact on civil society, but also increase the effectiveness of pre-trial investigations of hot pursuits and countering cyberattacks, the fight against which in the information war against Ukraine by the Russian Federation is vital for the entire Ukrainian population.
