Business met with the management of the Odesa Customs

    At the beginning of the meeting with business Acting Chief of Odesa Customs, Vitalii Zakolodiazhnyi, told about the meeting with his Romanian colleagues: Mykhailo Bukur, Galats Regional Customs Director, and Florentyn Bedescu, Isakcha customs post Director. This event took place within the agreements framework, reached at the recent tripartite meeting of the Heads of the customs services of Ukraine, Romania and Moldova. The main question was: what can be done at the regional level to reduce queues at the border and to promote the implementation of the Solidarity Paths proposed by the European Commission. The Romanian and Moldovan sides opened 3 additional checkpoints, which removed the restrictions for vehicles transiting from and to the EU. In addition, countries have removed restrictions on the provision of a certificate of origin for goods destined for non-EU countries and added officials who perform customs formalities.  Among the important legislative changes from the last meeting, the provisions of Law No. 2325 On Amendments to the Tax Code of Ukraine and other legislative acts of Ukraine regarding the revision of certain tax benefits dated June 21, 2022 were briefly outlined. In particular, it cancels benefits for the import of goods and certain transport means. Therefore, goods imported by natural persons-entrepreneurs and legal entities, regardless of the taxation system, will again be subject to import duty. And simplified groups I-III, who are not VAT payers, will again import goods with payment of VAT. These payments are returned for the import of individual vehicles imported by citizens. This is passenger cars, their bodies, trailers and semi-trailers, motorcycles, vehicles intended for the transportation of 10 people and more, vehicles for the transportation of goods. It was also about the ban on importing goods from the Russian Federation into the customs territory of Ukraine under the customs regime. The change came into effect in accordance with the Resolution of the Cabinet of Ministers of Ukraine On the Application of the Ban on the Import of Goods from the Russian Federation dated April 9, 2022 No. 426 and is one of the biggest changes over the past month.  In turn, Oleksandr Lazarev, Chairman of the EBA Odesa Coordination Council, Co-chairman of the EBA Customs Committee, noted that today there are no problems with the Customs, because the business had benefits that were canceled as of today, and there were no questions about the customs value. Currently only the deferred payment of customs payments and VAT on critical imported goods remain. But later, these benefits may be canceled, together with the reduction of the list of critical import goods, with the simultaneous cancellation of restrictions on payments in currency. In addition, we need to prepare for European integration processes that will greatly change customs clearance and control procedures. I strongly advise you to take a closer look at Bill No. 7420, which is, in essence, the new Customs Code. Business needs to be prepared for the fact that the EU has a very difficult customs control system without customs simplifications. International experts are considering the possibility of applying TIR-EPD without providing a preliminary declaration. This can help speed up our border crossing.  Also, as Mr. Zakolodyazhnyi notes, the capacity of the checkpoint depends precisely on the infrastructure, and not on the number of personnel located at the checkpoint. Therefore, the restoration of ports, infrastructure, loading and transshipment complex is underway today. As for the ports of Greater Odessa, we are all waiting for their opening. To date, many countries have announced the provision of convoys and the establishment of supplies. We hope that Odesa port will start operating soon. However, the decision to open the ports depends on the military and the help of partner countries.
