Business is against licensing the storage and transshipment of dangerous goods

  The European Business Association does not support draft law №1193-1 which provides for the risk of licensing the storage and transshipment of dangerous goods. This draft law was first registered in the Verkhovna Rada in September 2019. At the time, the EBA also opposed the adoption of the document, as some of its provisions regarding the transportation of dangerous goods were not consistent with European and international practices and could create additional regulatory burdens on business. In October 2021, an updated revised version of this draft law was published on the Verkhovna Radas website, which, unfortunately, did not take into account the vast majority of business comments. The EBA experts are mainly concerned about the fact that this draft law creates a basis for licensing operations for storage and transshipment of dangerous goods, which contradicts the principle of deregulation, as well as one of the main principles and conditions of Ukraines integration into Europe. Moreover, the licensing of such activities is not provided for in EU legislation or other international norms, and that should be the goal of the draft law. According to business, this document contradicts other laws of Ukraine, in particular, the Law on Permitting System in the Sphere of Economic Activity and the Law on Technical Regulations and Conformity Assessment and contains many other drawbacks. Therefore, the EBA cannot support draft law № 1193-1 in its current version and considers that it should be substantially revised with the obligatory involvement of the business community.
