Business community welcomes the decision of the Verkhovna Rada Committee on Digital Transformation, which prevents the introduction of discriminatory conditions for electronic communications operators

  On 14 January, Members of Parliament from the Committee did not support Draft Law No. 12112, On Amendments to Certain Laws of Ukraine in the Field of Electronic Communications Regarding the Regulation of Certain Issues of the Use of the Radio Frequency Spectrum, General Authorisation, and the Procedure for Maintaining the Register of Providers of Electronic Communications Networks and Services. They recommended that the Verkhovna Rada return the draft law to its author. The proposed amendments in this draft law included provisions granting unlimited discretion to the regulatory body in reviewing the conditions of already issued radio frequency spectrum licences. It also contained provisions that conflicted with Ukraines current international legal obligations in the field of European integration, as well as changes that, in violation of the Constitution of Ukraine, proposed retroactive application of laws. The European Business Association welcomes the Committees decision. We express our gratitude to the Members of Parliament, particularly Mykhailo Kryachko, as well as to state bodies – the Ministry of Economy of Ukraine, the State Regulatory Service of Ukraine, and the National Agency on Corruption Prevention – for supporting the business community and taking an active stance on this issue. The business community urges Members of the Verkhovna Rada of Ukraine to support the decision of the relevant Committee during their consideration of this issue and to refrain from adopting this draft law.
