Business is concerned about the possible resumption of tax audits during quarantine

  Yesterday, the media reported that the Security Service of Ukraine is going to appeal to the Verkhovna Rada Committee on Finance, Tax, and Customs Policy with a request to consider resuming tax audits. Thus, a moratorium on all tax audits (scheduled and unscheduled) was established by the relevant laws regulating business activities during quarantine (they are also prescribed in the Tax Code of Ukraine) to somewhat simplify the conditions for doing business during the quarantine. At the same time, in mid-September, the Verkhovna Rada registered the draft law №4101, which, unfortunately, provides for the lifting of the moratorium on audits for the period of quarantine. Honestly, the business is concerned about this situation - both with the draft law №4101 on increased fiscal pressure and the alleged statement of the Security Service of Ukraine. Now is surely not the time to create additional pressure on legal businesses. After all, the quarantine is still not lifted, and the business has not yet fully recovered. And the proposed changes will not stimulate the improvement of the economic situation, however, it constrains the work of transparent companies. Thus, the EBA member companies have concerns that as a result of the implementation of such proposals, state regulatory authorities will potentially be forced to perform tasks of aggressively attracting funds to the budget. Besides, it should be noted that the situation in the customs and tax spheres remains complicated. According to business representatives, there are still cases of cargo delays at the border, which often aims to create a situation when importers are forced to declare inflated customs value of goods under customs regulations (higher than in the contract) and thus increasing revenues from customs duties. There are also cases when authorized representatives of the State Tax Service carry out unreasonable suspension of registration of tax invoices and delays in reimbursement of VAT at the end of the year. Therefore, the community calls on the Verkhovna Rada to refrain from implementing norms that could become an additional tool of pressure on the business. Thus, it is important to prevent the lifting of the moratorium on tax audits until the end of the quarantine, so that companies can continue to work and look for opportunities to survive in this difficult time.
