Business offers to extend existing mobilization deferrals for another month

  On January 27, 2023, the Cabinet of Ministers of Ukraine adopted Resolution No. 76 On Reservation of Persons Liable for Military Service for the Period of Mobilization and Wartime, which approved the Procedure for Reservation of Persons Liable for Military Service. The Resolution stipulates that deferrals from military service during mobilization, which were granted to persons liable for military service by decisions of the Ministry of Economy of Ukraine before the Resolution came into force, are valid for the period for which they were granted. However, businesses, including representatives of the retail, pharmaceutical and medical industries, all areas of agriculture and other critical enterprises that have reserved their employees, are currently facing a situation where the period of draft deferral for employees who were reserved by businesses in the first place (in March 2022), considering all periods of automatic extension of deferral, expires in February 2023. At the same time, according to business, there are numerous cases when such employees received draft notices from the Territorial Recruitment and Social Support Centres requiring them to report to the Territorial centres for recruitment and social support the day after the expiration of the deferral period (for example, a draft notice was issued for February 16, 2023, and the deferral period expires on February 15, 2023). As of now, there are some uncertainties with the new Procedure in the context of the documentary evidence of compliance with certain criteria, since, for example, according to the latest information, local authorities and ministries are to determine the criteria of criticality for their areas and regions. Moreover, the ability of companies to provide information on some criteria is ambiguous (for example, on the submission of tax reports for the last quarter, as the deadline for submitting reports has not yet come). Therefore, according to preliminary business estimates, the procedure for reserving employees under the new Procedure will take about one month. Therefore, there is a high probability that businesses will not have time to complete the entire reservation procedure for the above-mentioned category of employees before the expiration of their deferment from military service, which, in turn, jeopardizes the sustainable functioning of individual enterprises and the economy as a whole. Therefore, the European Business Association appeals to the Prime Minister of Ukraine Denys Shmyhal to facilitate the extension of the current deferrals for another month. This will help businesses to complete the procedure for reserving employees in accordance with the new Procedure and continue to operate fully.
