Business proposes to optimize permitting procedures in urban planning

  The European Business Association has repeatedly emphasized on the necessity to optimize and digitalize the procedures in urban planning. Thus, construction covers more than 20 sectors of the economy, provides revenue to the state budget, job creation and new investment, but the existing procedures and rules are quite complex in terms of procedural, time, and financial costs. For many years, businesses have been facing difficulties with receiving permits at the beginning of the construction process and the final documents for its completion. For example, obtaining a construction permit, a certificate for the building commissioning, and so on. Thus, a construction permit or a refusal must be issued by the State Architectural and Construction Inspectorate of Ukraine (DABI) within 10 days from the date of registration of the application. At the same time, the business reports that this period is longer and can last up to several months, as the DABI often needs to obtain various additional documents and clarifications. However, without this document, the business cannot carry out further construction activities. Moreover, according to the business, it partially duplicates other documents already received such as the compliance of project documentation with relevant norms and standards, conclusions on environmental impact assessment, etc. Therefore, in order to optimize this process, the business proposes instead of the construction permit to notify the permitting body electronically with all the detailed information on the construction work - the customer, persons in charge of the construction, general contractor, etc. The business obtains the right to build once it receives the result of the examination of the project documentation in the form of the written report of the expert of the corresponding permitting body. The duplication can also be found in the procedure for obtaining a certificate for commissioning completed building facilities. Thus, this document certifies that the completed building complies with its project documentation and ready for operation. According to the law, this certificate must also be issued within 10 days, but, in fact, the terms are much longer. At the same time, there is an Act on Readiness of Facilities to Operate, which contains complete information about the building facilities. Thus, the Certificate duplicates the Act. Therefore, the business proposes to consider the Act as a document confirming the readiness of the building facility to operate, while the respective body of architectural and construction inspection should notify in writing the readiness of the facility to operate within 10 days after signing the Act. There should be reforms in the system while the responsibilities of the controlling body need to be divided effectively. In March, the government decided to create three separate agencies instead of the DABI. At the same time, the community does not care about the organizational structure of the body. For us is important to have a constructive and efficient system. We hope that the emphasis will be on the quality of work and reasonable regulations to improve the effectiveness of the construction industry and simplify existing procedures. Therefore, business appeals to the Ministry for Communities and Territories Development of Ukraine to consider the above proposals when reforming the construction industry and reformatting the State Architectural and Construction Inspectorate of Ukraine.
